บริษัท เมืองไทย แคปปิตอล จำกัด (มหาชน) และบริษัทในเครือ (“บริษัท”) ตระหนักดีถึงสิทธิในความเป็นส่วนตัวและหน้าที่ความรับผิดชอบของบริษัทเกี่ยวกับ การเก็บรวบรวม การใช้ การเปิดเผย (“ประมวลผล”) ข้อมูลส่วนบุคคลของลูกค้าและบุคคลภายนอก (“ท่าน”) บริษัทยึดค่านิยมที่ว่าความไว้วางใจและความเชื่อมั่นที่ท่านมีให้ เป็นสิ่งที่สำคัญที่สุดสิ่งหนึ่ง บริษัทจึงมุ่งมั่นที่จะจัดให้มีการประมวลผลข้อมูลส่วนบุคคลอย่างถูกต้องและเหมาะสม รวมทั้งเป็นไปตามที่ พระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (“พระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล”) กำหนดไว้ บริษัทจึงได้จัดทำประกาศการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้ขึ้นเพื่ออธิบายถึงวิธีการที่บริษัทปฏิบัติต่อข้อมูลส่วนบุคคล เช่น การเก็บรวบรวม การจัดเก็บรักษา การใช้ การเปิดเผย รวมถึงสิทธิต่าง ๆ ของท่านเพื่อให้ท่านได้รับทราบถึงแนวทางในการคุ้มครองข้อมูลส่วนบุคคลของบริษัท
1. ข้อมูลส่วนบุคคลที่บริษัทจัดเก็บรวบรวม
The Company processes personal data (including sensitive data as specified in Section 26 of the Personal Data Protection Act) as determined by the Personal Data Protection Committee (“Committee”). The types of data specified below are only the Company’s general framework for collecting personal information as follows:

If you provide personal information about another person, such as information about your spouse, information about family members, information about children, guardians, and dependents, information about the guarantor, information about beneficiaries or you request the Company to disclose personal information of another person to a third party, you are responsible for informing the details according to this Notification to such persons as well as asking for consent from that person.
ทั้งนี้ บริษัทจะไม่เก็บข้อมูลส่วนบุคคลที่อ่อนไหวของเจ้าของข้อมูลส่วนบุคคลอันได้แก่ ลักษณะทางพันธุกรรม พฤติกรรมทางเพศ หรือข้อมูลที่อาจเป็นผลร้าย ทำให้เสียชื่อเสียง หรืออาจก่อให้เกิดความรู้สึกเกี่ยวกับการเลือกปฏิบัติโดยไม่เป็นธรรมหรือความไม่เท่าเทียมกันแก่บุคคลใด เว้นแต่ บริษัทได้รับความยินยอมโดยชัดแจ้งจากท่าน หรือทำการจัดเก็บข้อมูลดังกล่าวภายใต้ฐานการประมวลผลข้อมูลส่วนบุคคลที่กฎหมายกำหนด
2. วิธีการได้มาและจัดเก็บข้อมูลส่วนบุคคลของท่าน
The Company will collect your personal information as necessary and on the basis required by law as follows:
- เมื่อท่านแสดงเจตนาจะเข้าทำสัญญา หรือช่วงก่อนระยะเวลาทำสัญญา เพื่อให้บริษัทตรวจสอบ คัดกรองคุณสมบัติจากใบสมัครงานรวมถึงเอกสารอื่น ๆ ของท่าน
- เมื่อท่านส่งเอกสารประกอบการพิจารณาในการรับเข้าทำหรือทำงานในบริษัท รวมถึงการลงนามในเอกสารให้ความยินยอมของท่าน
- เมื่อท่าน ติดต่อสื่อสารเป็นหนังสือหรือวาจาผ่านทางเว็บไซต์ แอปพลิเคชัน สื่อสังคมออนไลน์ โทรศัพท์ อีเมล การพบปะกันโดยตรง การสัมภาษณ์ ข้อความสั้น (SMS) โทรสาร ไปรษณีย์ หรือโดยวิธีการอื่นใด กับบุคลากร เจ้าหน้าที่ของบริษัท ผู้รับมอบอำนาจ ผู้กระทำการแทน หรือบุคคลอื่นหรือหน่วยงานอื่นที่เกี่ยวข้องของบริษัท (“บุคลากรและคู่ค้าของบริษัท”)
- เมื่อบริษัทได้รับข้อมูลส่วนบุคคลจากแหล่งที่มาอื่นที่มิใช่ท่านเอง ซึ่งรวมถึงแต่ไม่จำกัดเพียงการได้รับข้อมูลจากการตรวจสอบจากแหล่งข้อมูลที่เป็นสาธารณะ แหล่งข้อมูลส่วนตัว หรือแหล่งข้อมูลเชิงพาณิชย์ เว็บไซต์ แหล่งข้อมูลสื่อสังคมออนไลน์
- เมื่อบริษัทได้รับข้อมูลส่วนบุคคลจากแหล่งที่มาอื่นที่มิใช่ท่านเอง เพื่อวัตถุประสงค์ในการปฏิบัติตามกฎหมายและเพื่อวัตถุประสงค์เกี่ยวกับการกำกับดูแลในประการอื่น ๆ ตลอดจนเพื่อวัตถุประสงค์อื่น ๆ ที่ชอบด้วยกฎหมาย
3. วัตถุประสงค์และฐานในการประมวลผลข้อมูลส่วนบุคคล

| Legal Benefits | – การสรรหา การคัดเลือก และการดำเนินงานเกี่ยวกับการเข้าทำสัญญากับบริษัท โดยการประเมินคุณสมบัติตามข้อมูลที่ปรากฎในแหล่งข้อมูลที่เป็นสาธารณะ รวมถึงคุณสมบัติของท่าน – การบริหารความเสี่ยง การกำกับตรวจสอบ การบริหารจัดการภายในองค์กร รวมถึงการส่งต่อไปยังบริษัทในเครือกิจการเดียวกันเพื่อการดังกล่าว ภายใต้นโยบายการคุ้มครองข้อมูลส่วนบุคคลบริษัท – การทำให้ข้อมูลส่วนบุคคลเป็นข้อมูลที่ไม่สามารถระบุตัวบุคคลได้ – การป้องกัน รับมือ ลดความเสี่ยงที่อาจเกิดการกระทำการทุจริต การผิดนัดชำระหนี้หรือผิดสัญญา การทำผิดกฎหมายต่าง ซึ่งรวมถึงการเปิดเผยข้อมูลส่วนบุคคลเพื่อยกระดับมาตรฐานการทำงานของบริษัทในเครือกิจการ/ธุรกิจเดียวกันในการป้องกัน รับมือ ลดความเสี่ยง – การส่งพัสดุหรือจดหมาย |

In the event that the Company needs to collect personal information, if you refuse to provide personal information or object to the processing of personal data for the aforementioned purposes, it may result in the Company being unable to fully or partially carry out the services requested by you.
4. Disclosure of Your Personal Data

5. การส่งหรือโอนข้อมูลส่วนบุคคลไปยังต่างประเทศ (หากมี)
The Company may need to transmit or transfer personal data to affiliated companies or businesses in other countries or to other data recipients as part of normal business operations. For example, sending or transferring personal data to be stored on servers or cloud in various countries. The Company will ensure that the transmission or transfer of personal data complies with applicable laws and will implement necessary and appropriate data protection measures in accordance with standards.
6. ระยะเวลาในการจัดเก็บข้อมูลส่วนบุคคล
The Company will retain personal data for as long as necessary and reasonable to achieve the purposes stated in this Notification. We will retain your personal data for no more than 10 years from the end of the relationship or last contact with us. If legal proceedings or other necessities arise, personal data may be retained until the conclusion of such proceedings. This includes the possible timeframes for filing appeals and/or legislation. Afterward, the Company will have procedures in place to delete, destroy, or anonymize your personal data in accordance with applicable law.
7. มาตรการรักษาความมั่นคงความปลอดภัยข้อมูลส่วนบุคคล
As the Company recognizes the importance of maintaining the security of your personal data, we implement appropriate security measures to safeguard the confidentiality of personal data to prevent loss, unauthorized access, destruction, use, alteration, or disclosure of personal data without legal authorization or consent.
8. Your rights are as follows
- Right to Withdraw Consent: You have the right to withdraw consent that you have previously given for the processing of your personal data. However, withdrawing consent does not affect the legality of any processing performed before the withdrawal.
- Right to Object to Data Processing: You have the right to object to data processing by relying on legal grounds other than consent.
- สิทธิในการได้รับการแจ้งให้ทราบ ท่านมีสิทธิในการรับทราบข้อมูลของตนเองที่ได้มีการประมวลผลโดยบริษัทได้รับมาจากการเปิดเผยที่เกี่ยวกับการประมวลผลข้อมูลและขอให้บริษัททำสำเนาดังกล่าวแก่ท่าน
- สิทธิในการแก้ไขข้อมูล ท่านมีสิทธิยืนยันความถูกต้องและแก้ข้อมูลส่วนบุคคลเพื่อให้ข้อมูลดังกล่าวถูกต้องและเป็นปัจจุบัน
- สิทธิในการระงับการประมวลผลข้อมูลส่วนบุคคล ท่านมีสิทธิในการระงับการประมวลผลข้อมูลส่วนบุคคล ในกรณีดังกล่าวบริษัทจะไม่ประมวลผลข้อมูลของท่านนอกเหนือจากการจัดเก็บข้อมูลเพียงเท่านั้น
- Right to Request Deletion or Destruction of Personal Data: You have the right to request the deletion of your personal data from the Company’s records.
- Right to Receive and Transfer Data: You have the right to receive your personal data in a readable or usable format and request the Company to send or transfer such data to other data controllers. This right can be exercised if your personal data has been processed automatically based on consent, contract, or pre-contractual measures.
- Right to Lodge a Complaint: You have the right to lodge a complaint with relevant authority if you believe that the collection, use, or disclosure of your personal data violates applicable laws.
- Right to Access, Copy, or Disclose Data: You have the right to access, request copies, or disclose your personal data, including requesting disclosure of the sources of your personal data.
The Company will adhere to your rights when requested through appropriate channels such as branches, websites, email, and telephone. However, we reserve the right to not act upon your request if it is deemed appropriate and in accordance with the regulations. The Company may also charge reasonable fees for processing such requests.
9. Changes to the Personal Data Protection Notification
The Company reserves the right to amend, supplement, modify, update, or change this Notification as permitted by law to comply with legal requirements, changes in service provision, company operations, and feedback or suggestions from data subjects. The Company will announce any changes to this Notification if the modifications are material before implementing them. Direct notification will be provided to data subjects through any appropriate means.
